教师在法律上具有两种身份：普通公民和专业人员。
教师的权利如下：
1、教育教学权。这个权利是教师履行教学职责必备的权利，任何人以及组织不得剥夺以及侵犯；
2、学术研究权。这个权利是教师作为教学专业工作人员享有的基础权利。教师有权进行科研以及撰写、发表学术论文，也有权在学术团体中担任职务；
3、指导评价权。这个权利是教师能够指导学生的学业以及发展，对学生的品行以及学业成绩进行评定；
4、报酬待遇权。这个权利是教师能够按时领取工资报酬，享受国家统一规定的福利待遇，以及寒暑假期带薪休假；
5、参与管理权。教师能够对学校教育以及教学、管理工作提出建议以及意见；
6、进修培训权。教师享有进修培训权利，能够提升自身素质水准以及业务水准。
法律依据：《关于进一步减轻义务教育阶段学生作业负担和校外培训负担的意见》 第十六条
提升课堂教学质量。教育部门要指导学校健全教学管理规程，优化教学方式，强化教学管理，提升学生在校学习效率。学校要开齐开足开好国家规定课程，积极推进幼小科学衔接，帮助学生做好入学准备，严格按课程标准零起点教学，做到应教尽教，确保学生达到国家规定的学业质量标准。学校不得随意增减课时、提高难度、加快进度；降低考试压力，改进考试方法，不得有提前结课备考、违规统考、考题超标、考试排名等行为；考试成绩呈现实行等级制，坚决克服唯分数的倾向。
