小孩子打架受伤家长怎么处理呢 |

法律分析：小孩打架造成一方受伤的，由小孩监护人也就是家长来承担民事赔偿的责任，如果监护人有尽到监护责任的，则可以减轻其监护人的侵权责任。在打架斗殴中，行为人给对方的人身或财产带来损害，行为人要承担赔偿责任。如果行为人属无行为能力的人，自己不能承担赔偿责任的，则由监护人承担。受害人遭受人身损害但没有导致伤残和死亡后果的，赔偿义务人应当予以赔偿受害人因就医治疗支出的各项费用以及因误工减少的收入，包括医疗费、误工费、护理费、交通费、住宿费、住院伙食补助费、必要的营养费。
受害人因伤致残的，赔偿义务人应当赔偿受害人因增加生活上需要所支出的必要费用以及因丧失劳动能力导致的收入损失，包括残疾赔偿金、残疾辅助器具费、被抚养人生活费，以及因康复护理、继续治疗实际发生的必要的康复费、护理费、后续治疗费。受害人死亡的，赔偿义务人除应当根据抢救治疗情况赔偿上述规定的相关费用外，还应当赔偿丧葬费、被抚养人生活费、死亡补偿费以及受害人亲属办理丧葬事宜支出的交通费、住宿费和误工损失等其他合理费用。孩子之间进行打架，如果造成孩子受伤，由监护人承担赔偿的责任，监护人尽到监护责任的，可以减轻其侵权责任。
法律依据：《中华人民共和国民法典》 第一千一百八十八条 无民事行为能力人、限制民事行为能力人造成他人损害的，由监护人承担侵权责任。监护人尽到监护职责的，可以减轻其侵权责任。有财产的无民事行为能力人、限制民事行为能力人造成他人损害的，从本人财产中支付赔偿费用；不足部分，由监护人赔偿。
