释义	律师解答：借条没有约定还款期限的，从权利人主张权利或者知道权利被侵害之日起，超过三年的不受法律保护。也就是说申诉时效是三年。即使欠条已超过五年，但对方拒绝归还借款，在借条或欠条过了诉讼时效的情形下，仍然可以向法院提起诉讼要求债务人归还借款。法院并不会以借条过了诉讼时效，而不予受理。【法律依据】：《中华人民共和国民法典》第一百九十三条人民法院不得主动适用诉讼时效的规定。
