释义	法律分析：竞买人之间、竞买人与拍卖人之间恶意串通，给他人造成损害的，拍卖应予无效，即属拍卖无效。所谓无效拍卖，是指违反法律规定或可能造成消极社会影响而其后果不为法律所承认可拍卖活动。无效拍卖损害有关当事人的利益，或者国家和社会公共利益，故为法律所禁止。法律依据：《中华人民共和国拍卖法》第二十二条拍卖人及其工作人员不得以竞买人的身份参与自己组织的拍卖活动，并不得委托他人代为竞买。第二十三条拍卖人不得在自己组织的拍卖活动中拍卖自己的物品或者财产权利。
