释义	有两种情况在合同期内用人单位是可以变更劳动者工作岗位的。根据原劳动部办公厅《关于职工因岗位变更与企业发生劳动争议等有关问题的复函》（劳办发〔1996〕100号）的规定精神，符合以下情况，用人单位可以变更劳动者工作岗位：一是劳动合同签订时所依据的客观情况发生重大变化。如企业生产经营状况发生严重困难，不得不调整劳动者工作岗位的。但变更岗位须经双方当事人协商一致，若不能达成协议，则可按法定程序解除劳动合同。二是因劳动者不能胜任工作，企业有权作出调整工作岗位的决定，行使企业自主权。
