涉外商事合同诉讼管辖权的相关规定是由合同签订地、合同履行地、诉讼标的物所在地、侵权行为地或者代表机构住所地的人民法院来管辖。前提条件要建立在被告方在中华人民共和国领域内有可供扣押的财产，或者在中华人民共和国领域内设有代表机构，合同是在我国境内履行的。
法律依据：
《中华人民共和国民事诉讼法》 第二十三条 因合同纠纷提起的诉讼，由被告住所地或者合同履行地人民法院管辖。
