释义	法律分析：理论上我国对开公司的行为没有年龄要求，但是我国法律对担任公司法定代表人年龄有限制。不能担任公司法定代表人的各种情形，其中一项明确说明，无民事行为能力人和限制民事行为能力人不得担任法定代表人，即担任法定代表人，至少需要年满十八周岁。法律依据：《中华人民共和国民事诉讼法》第三条人民法院受理公民之间、法人之间、其他组织之间以及他们相互之间因财产关系和人身关系提起的民事诉讼，适用本法的规定。
