法律分析：逮捕权由公、检、法机关行使，其他任何机关、团体和个人都无权行使。在公、检、法机关之间，逮捕的权限是不同的，具有一定的分工。人民检察院和人民法院有权决定逮捕，人民检察院具有批准逮捕权，公安机关对自己侦查的案件，认为需要逮捕犯罪嫌疑人的时候，应当依法提请人民检察院审查批准，它无权自行逮捕。
法律依据：《中华人民共和国刑事诉讼法》第八十条
逮捕犯罪嫌疑人、被告人，必须经过人民检察院批准或者人民法院决定，由公安机关执行。
