释义	法律分析: 依据我国相关法律的规定，借款合同利息是按年还是按月计算是没有规定的，但一般情况下按年计算的。法律依据: 《贷款通则》第十一条贷款限期根据借款人的生产经营周期、还款能力和贷款人的资金供给能力由借贷双方共同商议后确定，并在借款合同中载明。第十二条不能按期归还贷款的，借款人应当在贷款到期日之前，向贷款人申请贷款展期。是否展期由贷款人决定。第三十二条借款人提前归还贷款，应当与贷款人协商。
