释义	法律分析：质押合同的法律效力是：(一)出质人代质权人占有质物的，质押合同不生效；质权人将质物返还于出质人后，以其质权对抗第三人的，人民法院不予支持。(二)因不可归责于质权人的事由而丧失对质物的占有，质权人可以向不当占有人请求停止侵害、恢复原状、返还质物。(三)出质人和质权人应当以书面形式订立质押合同。法律依据：《中华人民共和国民法典》第四百二十九条质权自出质人交付质押财产时设立。
