释义	我国实行行政主管部门与人民法院均可认定的双轨制，但须以当事人提出申请或请求为前提，并且该申请或请求必须建立在相关权益受损的基础上。驰名商标的保护也不同于普通商标仅限于相同或相似的商品，驰名商标采取跨类或者跨群组保护。如果在具体案件中行政机关或者司法机关认定某个商标为驰名商标，则在该案或者其它继续认定的案件中系争商标的所有人不得使得用该商标。人民法院在审理商标纠纷案件中，根据当事人的请求和案件的具体情况，可以对涉及的注册商标是否驰名依法作出认定。
