释义	交易中商品货物不合格，可以退货，并且可以主张违约赔偿责任；在实际主张的时候，又具体分为两种情形来主张：合同中有明确约定的按照约定来主张。买卖合同中没有明确约定或者约定不明的。买卖合同货物收货后发现不合格，可以退货，并且可以主张违约赔偿责任。根据《合同法》第一百五十八条，当事人约定检验期间的，买受人应当在检验期间内将标的物的数量或者质量不符合约定的情形通知出卖人。
