释义	抢劫罪是指以非法占有为目的，以暴力、胁迫或者其他方法，强取公私财物的行为。因为抢劫罪，是一种严重侵犯公民人身权利、财产权利的犯罪，所以对于抢劫罪的量刑起点刑就是三年，也即只要构成抢劫罪，就要判处三年以上有期徒刑。如果属于抢劫罪的从犯，因为从犯，作为法律规定的可以从轻或者减轻处罚的情节，如果抢劫罪的情节一般，不属于法律规定的应当判处十年以上的情况，是可以争取缓刑的。法律依据：《中华人民共和国刑法》第二百六十三条规定：
