释义	法律分析: 合同无效不需要经过法院认定，可以双方协商认定无效，可由人民法院进行确定。合同无效后不影响其他部分效力的仍然有效，应当认可之前的履行，对于无效行为取得的财产予以返还或作折价补偿。《中华人民共和国民法典》第五百零七条合同不生效、无效、被撤销或者终止的，不影响合同中有关解决争议方法的条款的效力。
