释义	根据刑法第二十六条第一款的规定，组织、领导犯罪集团进行犯罪活动或者在共同犯罪中起主要作用的，是主犯。主犯包括两类：一是组织、领导犯罪集团进行犯罪活动的犯罪分子，即犯罪集团中的首要分子；二是其他在共同犯罪中起主要作用的犯罪分子，即除犯罪集团的首要分子以外的在共同犯罪中对共同犯罪的形成、实施与完成起决定或重要作用的犯罪分子。犯罪分子是否起主要作用，应从主客观方面进行综合判断。对主犯的认定，应以共犯人的主客观事实为依据，以刑法第二十六条的规定为准绳，不能任意扩大或者缩小主犯的范围。
