释义	法律分析: 开发商没有预售证就卖房子违法。按规定房屋未建好之前出售均要办理《商品房预售许可证》，房产商将有关资料送到市住房和城乡规划建设局申请，批准后方可预售楼房。法律依据:《《城市商品房预售管理办法》》第五条商品房预售应当符合下列条件: （一）已交付全部土地使用权出让金，取得土地使用权证书；（二）持有建设工程规划许可证和施工许可证；（三）按提供预售的商品房计算，投入开发建设的资金达到工程建设总投资的25％以上，并已经确定施工进度和竣工交付日期。
