集体用地和农业用地的区别

释义

法律主观：

集体用地属于农民集体所有的土地，可分为耕地、林地等，个人不能买卖和租用农耕地。要征地也只能由政府来收并转换土地性质，把耕地转成工业或住宅用地，并由国土部门登记。

法律客观：

《中华人民共和国土地管理法》第九条城市市区的土地属于国家所有。农村和城市郊区的土地，除由法律规定属于国家所有的以外，属于农民集体所有；宅基地和自留地、自留山，属于农民集体所有。
