释义	担保人可以是家人，但是家人、直属亲人做担保人需要具备相应的民事行为能力，并且一般要求具备一定的清偿能力。法律依据：《中华人民共和国民法典》第六百八十三条机关法人不得为保证人，但是经国务院批准为使用外国政府或者国际经济组织贷款进行转贷的除外。以公益为目的的非营利法人、非法人组织不得为保证人。第六百八十一条保证合同是为保障债权的实现，保证人和债权人约定，当债务人不履行到期债务或者发生当事人约定的情形时，保证人履行债务或者承担责任的合同。
