破产确定债权债务是要审理的。
【法律依据】:
《中华人民共和国企业破产法》
第四十五条 人民法院受理破产申请后，应当确定债权人申报债权的期限。债权申报期限自人民法院发布受理破产申请公告之日起计算，最短不得少于三十日，最长不得超过三个月。
第四十六条 未到期的债权，在破产申请受理时视为到期。
附利息的债权自破产申请受理时起停止计息。
第四十七条 附条件、附期限的债权和诉讼、仲裁未决的债权，债权人可以申报。
