释义	法律分析: 目前我国法律制度规定的合同无效的情形只有以下5种：一、无民事行为能力人签的合同无效。二、行为人与相对人以虚假的意思表示签的合同无效。三、违反法律、行政法规的强制性规定的合同无效。但是，该强制性规定不导致该民事法律行为无效的除外。四、违背公序良俗的合同无效。五、行为人与相对人恶意串通，损害他人合法权益的合同无效。《中华人民共和国民法典》第五百七十七条当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
