释义	法律分析：不需要。对有证据证明有犯罪事实，可能判处徒刑以上刑罚的犯罪嫌疑人、被告人，采取取保候审尚不足以防止发生下列社会危险性的，应当予以逮捕。法律依据：《中华人民共和国刑法》第四十二条拘役的期限，为一个月以上六个月以下。第四十三条被判处拘役的犯罪分子，由公安机关就近执行。在执行期间，被判处拘役的犯罪分子每月可以回家一天至两天;参加劳动的，可以酌量发给报酬。第四十四条拘役的刑期，从判决执行之日起计算;判决执行以前先行羁押的，羁押一日折抵刑期一日。
