释义	法律分析：新刑法对违令作战消极罪既遂的量刑标准为：犯本罪的，处5年以下有期徒刑。违令作战消极罪是指指挥人员违抗命令，临阵畏缩，作战消极，造成严重后果的行为。违抗命令，扰乱作战部署或者贻误战机、或造成武器装备、军事设施、军用物资或者其他财产损毁，直接经济损失二十万元以上的，构成本罪，应立案追诉。法律依据：《中华人民共和国刑法》第四百二十八条指挥人员违抗命令，临阵畏缩，作战消极，造成严重后果的，处五年以下有期徒刑；致使战斗、战役遭受重大损失或者有其他特别严重情节的，处五年以下有期徒刑。
