释义	民间借贷的年利率原则上不能超过24%。未超过年利率24%部分的利息法院予以保护;超过年利率24%，但未超过年利率36%部分的利息，已给付的不能再要求对方返还，未给付的也不能再要求对方给付;超过年利率36%部分的利息约定无效，已给付的也可以要求对方返还。民间借贷中存在的“砍头息”是不受法律保护的。出借人在出借款项时，预先在本金中扣除的利息，不能计入借款本金，要求借款人返还。
