释义	法律分析：在实习期用人单位与学生不存在劳动关系，不能计算工龄。学生参加跟岗实习、顶岗实习前，职业学校、实习单位、学生三方应签订实习协议。用人单位自用工之日起即与劳动者建立劳动关系，开始计算工龄。法律依据：《中华人民共和国职业学校学生实习管理规定》第十二条学生参加跟岗实习、顶岗实习前，职业学校、实习单位、学生三方应签订实习协议。协议文本由当事方各执一份。未按规定签订实习协议的，不得安排学生实习。认识实习按照一般校外活动有关规定进行管理。
