释义	法律分析：只有在婚姻一方当事人自然死亡或一方当事人下落不明满四年经过另一方当事人申请法院宣告其死亡的，产生婚姻自动解除的法律后果。除此之外，离婚必须经过双方协商后到婚姻登记机关领取离婚证，或者经过诉讼由法院判决或调解离婚。法律依据：《中华人民共和国民法典》第五十一条被宣告死亡的人的婚姻关系，自死亡宣告之日起消除。死亡宣告被撤销的，婚姻关系自撤销死亡宣告之日起自行恢复。但是，其配偶再婚或者向婚姻登记机关书面声明不愿意恢复的除外。
