贷款办不下来可以退房。购房者应向开发商发出退房通知办理退房手续，开发商返还购房款，根据按揭贷款办下不来的原因确定违约方，由违约方依据合同约定承担相应的违约责任。当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
开发商的原因：如果开发商销售未具备销售条件的房屋，即开发商未取得预售许可证或销售不具备使用条件的现房，银行审查时发现这种情况是不会批贷款的，此时购房者可要求开发商退还首付及定金，并要求开发商支付相应的利息损失。购房者的原因：如果购房者提供的资料不真实或者购房者的信用记录不好造成银行不予批准贷款，购房者应该承担违约责任。
非买卖双方的原因：如果政府的政策或者银行的规定发生变化导致购房者本应拿到的贷款不能实现，购房者应与开发商协商，协商不成合同上又没有约定的。购房者可以起诉并举证自己没有过错并确实无力购房，要求开发商发还首付及定金。
【法律依据】：《中华人民共和国民法典》第五百六十三条有下列情形之一的，当事人可以解除合同：（一）因不可抗力致使不能实现合同目的；（二）在履行期限届满前，当事人一方明确表示或者以自己的行为表明不履行主要债务；（三）当事人一方迟延履行主要债务，经催告后在合理期限内仍未履行；（四）当事人一方迟延履行债务或者有其他违约行为致使不能实现合同目的；（五）法律规定的其他情形。以持续履行的债务为内容的不定期合同，当事人可以随时解除合同，但是应当在合理期限之前通知对方。
