《关于审理涉及计算机网络著作权纠纷案件适用法律若干问题的解释》 中的观点，“侵权行为地”是“实施被诉侵权行为的网络服务器、计算机终端等设备所在地”。侵权结果地的认定首先应坚持禁止一定因素作为确认管辖权的基础，同时应确立合乎目前国情的确定侵权结果发生地因素，如被告对侵权结果地预知并故意希望侵权结果在该地实现，则这类侵权结果地的法院享有管辖权。
