释义	法律分析: 劳动者与同一个单位签订两份劳动合同，只有一份劳动合同生效，一般是后签订的劳动合同。单位借此逃税的，应当依法补缴欠缴的税款，构成犯罪的，依法承担刑事责任。《中华人民共和国劳动合同法》第十六条劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。劳动合同文本由用人单位和劳动者各执一份。
