释义	法律分析：民间借贷中，债权人与债务人协议以新贷偿还旧贷，等同于新贷保证人为旧贷提供担保，在前后保证人非同一人且新贷保证人并不知情的情况下，有违保证人真实意思，保证人不应承担民事责任。法律依据：《中华人民共和国担保法》第三十九条主合同当事人双方协议以新贷偿还旧贷，除保证人知道或者应当知道的外，保证人不承担民事责任。
