释义	签订协议的，有担保人的，必须有担保人亲自签字，否则，担保人不承担还款责任，由签订协议的一方还款。担保是指法律为确保特定的债权人实现债权，以债务人或第三人的信用或者特定财产来督促债务人履行债务的制度。法律依据：《中华人民共和国担保法》第四十八条行为人没有代理权、超越代理权或者代理权终止后以被代理人名义订立的合同，未经被代理人追认，对被代理人不发生效力，由行为人承担责任。根据以上规定担保人不是本人签字不承担担保责任。
