释义
不构成犯罪。确定女孩真实年龄，如果女孩超过14周岁，并且女方自愿发生性关系，则不构成罪。如果强制违背女方意志，强行与女方发生性关系，则认定为罪。根据相关法律规定，行为人明知对方是不满十四周岁的而与其发生性关系，不论是否自愿，以罪定罪处罚；行为人确实不知对方是不满十四周岁的，双方自愿发生性关系，未造成严重后果，情节显著轻微的，不认为是犯罪。
