无抵押人承诺的抵押担保合同能成立吗
释义
能成立。但是这份协议只对合同双方有效，对外还需要承担担保责任。抵押合同要成立，也必须是承诺通知到达要约人时才成立。承诺通知必须是由承诺人作出。符合上述条件，无抵押人承诺的抵押担保合同也能成立。
法律依据：
《中华人民共和国民法典》 第一百一十九条 依法成立的合同，对当事人具有法律约束力。
