释义	法律分析: 一般来说合同违约金上限是不超过实际损失的30%。但是如果过高或者过低是可以请求法院给予减少或者增加的。违约金是当事人双方在订约时对一方违约后可能造成的损失的一种预先估算，与违约后守约方的实际损失不可能完全相符，故此可交由法官自由裁量。法律依据: 《中华人民共和国民法典》第五百八十二条质量不符合约定的，应当按照当事人的约定，承担违约责任。
