2023年用人单位与职工解除劳动关系的证明如何出具

法律分析:
解除劳动合同证明是劳动者在单位离职时,单位开具的证明。一般情况下都是单位出具,然后去当地人力资源与社会保障局的劳动关系科盖章办理解除。如果超期了的话,可能还要根据办事部门要求提供盖公章的证明材料。
法律依据:
《中华人民共和国劳动合同法》 第五十条 用人单位应当在解除或者终止劳动合同时出具解除或者终止劳动合同的证明,并在十五日内为劳动者办理档案和社会保险关系转移手续。
