释义	1、无效婚姻是因欠缺婚姻的成立条件，不具有法律效力的婚姻。具有以下情形之一的，婚姻无效：（1）重婚；（2）有禁止结婚的亲属关系；（3）未到法定婚龄。 2、确认婚姻无效必须是婚姻当事人及利害关系人向法院起诉，由法院判决。该婚姻被确认无效的，自始无效。其中，利害关系人包括：（一）以重婚为由的，为当事人的近亲属及基层组织；（二）以未到法定婚龄为由的，为未到法定婚龄者的近亲属；（三）以有禁止结婚的亲属关系为由的，为当事人的近亲属。法律依据《中华人民共和国民法典》第一千零五十一条
