释义	法律分析: 遗嘱继承和遗赠继承顺序冲突的话一般是以遗赠继承顺序为准的，遗产继承开始之后，肯定是遗嘱继承和遗赠继承要优先于法定继承顺序的，如果同时存在遗嘱和遗赠抚养协议的话，应该按照协议来继承遗产。法律依据: 《中华人民共和国民法典》第一千一百三十三条自然人可以依照本法规定立遗嘱处分个人财产，并可以指定遗嘱执行人。自然人可以立遗嘱将个人财产指定由法定继承人中的一人或者数人继承。自然人可以立遗嘱将个人财产赠与国家、集体或者法定继承人以外的组织、个人。自然人可以依法设立遗嘱信托。
