法律分析：强奸罪，是指违背妇女意志，使用暴力、胁迫或者其他手段，强行与妇女发生性交的行为，或者故意与不满14周岁的幼女发生性关系的行为。
强迫卖淫罪，是指以暴力、胁迫或者其他手段，迫使他人卖淫的行为。
二者主要区别是：
1.二者侵害的客体不同。强迫卖淫罪侵害的客体是社会主义的道德风尚与公民的人身权利;而强奸罪侵害的客体是妇女的性自由权利。
2.二者侵害的对象不同。强迫卖淫罪侵害的对象既可以是女性，又可以是男性;而强奸罪侵害的对象只能是女性。
3.行为人的故意内容不同。强迫卖淫罪的行为人的故意内容是为了获取钱财而强迫他人卖淫;强奸罪的行为人则是为了同他人发生性关系而实施暴力、胁迫等行为。
法律依据：《刑法》第二百三十六条，以暴力、胁迫或者其他手段强奸妇女的，处三年以上十年以下有期徒刑。奸淫不满十四周岁的幼女的，以强奸论，从重处罚。
《刑法》第三百五十八条，组织、强迫他人卖淫的，处五年以上十年以下有期徒刑，并处罚金;情节严重的，处十年以上有期徒刑或者无期徒刑，并处罚金或者没收财产。组织、强迫未成年人卖淫的，依照前款的规定从重处罚。
