法律分析：一、有证据证明曾到医疗机构就医，被诊断为患有严重性病的；
二、根据本人的知识和经验，能够知道自己患有严重性病的；
三、通过其他方法能够证明是“明知”的。
法律依据：《中华人民共和国刑法》 第三百六十条 明知自己患有艾滋、梅毒、淋病等严重性病卖淫、嫖娼的，处5年以下有期徒刑、拘役或者管制，并处罚金。
