释义	根据我国《刑法》第72条的规定，对于判处拘役三年以下有期徒刑的犯罪分子，如果符合以下条件的，可以宣告缓刑。而对于不满18周岁的人、怀孕的妇女，或者是以满75周岁的人，则应当宣告缓刑。这四个条件是，犯罪情节较轻，有悔罪表现，没有再犯罪的危险，宣告缓刑对于所居住的社区没有重大不良影响，这是适用缓刑的正面条件。同时，刑法对于不得判处缓刑的条件也做了规定，根据《刑法》第74条规定，对于累犯和犯罪集团的首要分子不适用缓刑。如果再加上72条的规定，判处三年以上有期徒刑的犯罪分子，也不能判处缓刑。
