释义	危险犯不能构成犯罪中止。危险犯是以对合法权益发生侵害的危险作为处罚根据的犯罪，行为人实施的行为足以造成某种危害结果发生的危险状态时，就是危险犯的既遂。《中华人民共和国刑法》第二十四条在犯罪过程中，自动放弃犯罪或者自动有效地防止犯罪结果发生的，是犯罪中止。对于中止犯，没有造成损害的，应当免除处罚；造成损害的，应当减轻处罚。法律依据《中华人民共和国刑法》第二十四条
