释义	法律分析：“挂靠”关系中，挂靠双方对工程质量发生的纠纷、拖欠工程材料款、劳务费发生的纠纷、以被挂靠方分支机构的名义擅自对外担保的纠纷等必须承担连带责任。没有担保的，不承担连带责任。法律依据：《民事诉讼法司法解释》第五十四条以挂靠形式从事民事活动，当事人请求由挂靠人和被挂靠人依法承担民事责任的，该挂靠人和被挂靠人为共同诉讼人。
