释义	法律分析：被告人不服一审判决的，可以提起上诉，是否能改变判决减轻处罚，还要由二审法院审理后根据案情决定。并不是上诉就会减轻处罚。法律依据：《全国人民代表大会关于修改《中华人民共和国刑事诉讼法》的决定》八十五、第一百二十九条改为第一百八十条，第一款修改为：“被告人、自诉人和他们的法定代理人，不服地方各级人民法院第一审的判决、裁定，有权用书状或者口头向上一级人民法院上诉。被告人的辩护人和近亲属，经被告人同意，可以提出上诉。”
