释义	法律分析：倘若刑罚过重，譬如盗窃判死刑，容易引导一些犯罪分子铤而走险，本来或许只是想盗窃，反正盗窃和杀人一样都是死刑，那盗窃不如杀人来得干脆。量刑过重可以一审案件，可以在十日内提出上诉;如果是二审判决，可以申诉。法律依据：《中华人民共和国刑事诉讼法》第二百二十九条被害人及其法定代理人不服地方各级人民法院第一审的判决的，自收到判决书后五日以内，有权请求人民检察院提出抗诉。人民检察院自收到被害人及其法定代理人的请求后五日以内，应当作出是否抗诉的决定并且答复请求人。
