释义	集体合同的产生除要经过双方代表协商、职代会审议通过、首席代表签字程序以外，劳动保障部门依法对集体合同进行审查，是集体合同生效的必经程序。集体合同签订后，用人单位应在10日内将集体合同文本及有关说明材料报送劳动保障部门。劳动保障部门在收到集体合同文本后15个工作日内未提出异议的，集体合同即日生效。报送单位应以适当方式予以公布。劳动保障行政部门提出异议，用人单位就异议事项经协商重新签订集体合同的，应按照报送程序重新报送劳动保障部门审查。
