释义	法律分析：由于无偿代驾不计取报酬，属于义务帮工的性质。我国无偿代驾致人损害的，应当由车主承担赔偿责任。如果车主明确表示拒绝让对方代驾的，则车主不用承担责任。如果无偿代驾者对事故的发生存在故意，或者重大过失的，要承担连带责任。法律依据：《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》第十三条规定，为他人无偿提供劳务的帮工人，在从事帮工活动中致人损害的，被帮工人应当承担赔偿责任。被帮工人明确拒绝帮工的，不承担赔偿责任。
