释义	死缓符合法定的条件能适用假释。根据法律规定，被判处死刑缓期执行的罪犯减为无期徒刑或者有期徒刑后，实际执行十五年以上，方可假释，该实际执行时间应当从死刑缓期执行期满之日起计算。死刑缓期执行期间不包括在内，判决确定以前先行羁押的时间不予折抵。法律依据《最高人民法院关于办理减刑、假释案件具体应用法律若干问题的规定》第二十三条《中华人民共和国刑法》第八十一条
