释义	法律分析: 支票并没有主债务人。主债务人，就是无条件付款的票据关系人。支票的出票人签发支票后，首先由付款人，就是出票人的付款。如果出票人账户余额不足，银行是不付款的。所以，银行虽然是付款人，但是并不是主债务人。支票的出票人，虽然最终款项是从出票人付的，但是首先应该由银行付款。所以，出票人也不是主债务人。法律依据: 《中华人民共和国民法典》第三百八十六条担保物权人在债务人不履行到期债务或者发生当事人约定的实现担保物权的情形，依法享有就担保财产优先受偿的权利，但是法律另有规定的除外。
