释义	即使没有合伙协议，只要双方存在合伙的事实，即可认为其存在合伙关系。当合伙关系终止时，对合伙财产的处置根据法律规定，有书面协议的，按书面协议处置，没有书面协议，又协商不成，同时合伙人出资数额不等的，可以按出资额多的合伙人意见处置。但同时也要保护其他合伙人的利益。法律依据：《中华人民共和国民法典》第二百一十五条当事人之间订立有关设立、变更、转让和消灭不动产物权的合同，除法律另有规定或者当事人另有约定外，自合同成立时生效；未办理物权登记的，不影响合同效力。
