释义	无效。在起诉前，如果开发商还没有取到商品房预售许可证明的，该合同自始无效。虽然案件审结前，开发商具备了办理产权证的条件，但是根据该司法解释仍然会认定。法律依据：《最高人民法院关于审理纠纷适用法律若干问题的解释》第二条规定：出卖人未取得明，与买受人订立的，应当认定无效，但是在起诉前取得商品房预售许可证明的，可以认定有效。
