释义	律师解答：担保人可以起诉债务人。担保人需要起诉借款人的，应该向借款人所在地的法院起诉，在起诉时，担保人应该提供为借款人进行担保的证据、担保人已经履行担保责任的证据。担保人起诉借款人的，属于行使追偿权，应该在担保人已经承担了担保责任后（即代为向债权人偿还了借款人的借款），才可以向借款人进行追偿。【法律依据】：《中华人民共和国民法典》第七百条保证人承担保证责任后，除当事人另有约定外，有权在其承担保证责任的范围内向债务人追偿，享有债权人对债务人的权利，但是不得损害债权人的利益。
